The following Terms & Conditions ("T&C") contain the terms and conditions that govern your use of the Web Site and FreeGamerGoodies Service (as defined below). These T&C describe your rights and responsibilities and what you can expect from the FreeGamerGoodies Service. If you do not read, understand, and agree to all of the T&C, you may not use the Web Site.

FreeGamerGoodies reserves the right to add to, delete or change these T&C because of frequent changes in Internet technology and applicable law. As such, you should check these T&C from time to time for such changes.

1) The FreeGamerGoodies Service

FreeGamerGoodies allows customers to earn free gifts by completing advertiser-sponsored offers, and referring a certain number of people to the site who must also complete offer credit requirements.

2) Account Structure

a. There is no cost to create an FreeGamerGoodies account. Only one account is allowed per person, per IP address and only one account per household. Each user may create one FreeGamerGoodies ID, which is used to create an account on any other FreeGamerGoodies web sites.

b. Users are not allowed to create multiple accounts by using multiple addresses or IP addresses.

c. FreeGamerGoodies accounts are non-transferable.

d. Breach of these terms will result in account closure and all credits will be forfeited.

e. Users with closed accounts are forbidden from creating a new account on any FreeGamerGoodies web sites.

f. Users are responsible for securing their FreeGamerGoodies account information. Accounts found or reported to be compromised will be immediately locked and all credits will be forfeited. FreeGamerGoodies is not responsible for losses incurred due to compromised accounts.

3) Gift Fulfillment

a. Users are limited to unlimited gift rewards, just request a reset of offer requirements once fulfilling the requirements once.

b. Gifts cannot be shipped to P.O. Box addresses or APO addresses.

c. Federal Law requires FreeGamerGoodies to collect a W9 from if a reward is worth $600 or more. Users will forfeit gifts and offer credits if a completed W9 form is not provided.

d. All orders are subject to approval based on, but not limited to, the following requirements: correct account information, offer and referral requirements have been met and user does not have more than one account.

e. FreeGamerGoodies cannot guarantee delivery times, but will ensure measures are taken to provide for delivery within a reasonable amount of time.

f. Users must be sure to provide correct shipping information to FreeGamerGoodies in order to receive their gift. FreeGamerGoodies is not responsible for lost or stolen shipments.

g. Typical gift delivery upon order approval can take up to 3-5 Business Days.

4)Offers/Offer Credits

a. Each user must complete his or her own offer requirements. Users may not solicit or otherwise permit another individual to complete offers on their account or use another persons name or address when completing offers.

b. FreeGamerGoodies is not responsible for requirements or terms of advertisers presented on this site. Please review all advertiser policies and terms before completing an offer. FreeGamerGoodies is not responsible for any contracts or charges incurred by its users while completing advertised offers.

c. In order to receive credit for offers, users must sign-up by clicking the unique link/banner provided on the FreeGamerGoodies offers page. Users are advised to disable popup blockers and ensure your browser allows cookies in order to receive credit.

d. Users may not complete an offer more than one time. Multiple offer completions of the same offer will result in account closure and forfeiture of gifts. If we are informed that a user completed the same offer elsewhere, by our publishers or other site owners, this will result in immediate account termination!

e. Offer credits are subject to verification of the actual completed requirements. FreeGamerGoodies reserves the right to refuse or revoke credits for offer completions for a number of reasons, including but not limited to, duplicate completions, fraudulent information, under age, early cancellation, or non-payment from advertisers/publishers.

f. All Web Hosting offer accounts must remain active for 60 days to ensure legitimate crediting.

g. Crediting time varies for each offer completion. FreeGamerGoodies is not liable for lead reporting delays of credits or no credit situations. Users may not always receive credit for completions due to circumstances beyond our control. Credits may be refused as the result of, but not limited to, the following situations: fraudulent sign-up information, failure to meet requirements, use of pre-paid cards, or duplicate offer completions.

h. Offer credits/points are non-transferable between FreeGamerGoodies gift sites, nor are referral accounts.

i. FreeGamerGoodies does not have access to any information submitted to or used by the advertiser of completed offers. You must directly contact the company of the offer you complete for any questions or concerns you have concerning your enrollment. Do not contact them with concerns on lead reporting as we work with many third party affiliates and advertisers will rarely understand your questions to them.

j. Use of Pre-Paid giftcards of any kind are not allowed nor permitted when participating in offers. Security-based credit cards that are self-generated with a limit are considered a Pre-Paid non-rebillable card.

5) Your Registration Obligations

a. Account registration is required in order to create a FreeGamerGoodies ID. During registration, all users are required to provide accurate, complete and current information about themselves in all required fields. Should any of your own information change after submitting it to FreeGamerGoodies, you are hereby required to update that information as soon as possible. Should FreeGamerGoodies suspect that your personal information is not complete, current, or accurate, your account may be subject to suspension or termination FreeGamerGoodies is not intended for children under the age of 18.

b. Users must create their own account. Users are not allowed, under any circumstances, to register or participate on behalf of anyone other then themselves.

c. To register and participate on FreeGamerGoodies, users must reside and participate from within the United States, Canada, United Kingdom and Australia Accounts created or pursued from outside these locations will result in account closure and all credits will be forfeited.

d. Spamming is not permitted nor tolerated in any form. All reports of spamming will be investigated and may result in account closure and forfeiture of gift.

e. If you are found to be scamming or stealing referrals in order to obtain your prize, we reserve the right to properly investigate the situation in question. We also reserve the right to cancel/disqualify your account in event we find you guilty of scamming or stealing.

6) Privacy Policy

Your use of the Service is subject to FreeGamerGoodies privacy policy.

7) Indemnity

You agree to indemnify and hold FreeGamerGoodies and its owners, employees and other partners, harmless from any alleged damage, loss, or expense, including without limitation, attorneys' fees and costs, made by any third party due to or arising out of your content, your use of the Service, your connection to the Service, your violation of the T&C, or your violation of any rights of another, whether you are a registered user or not. The user is solely responsible for his or her actions when using the Service, including, but not limited to, costs incurred for Internet access.

8) Member Conduct

a. Any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable behavior towards any FreeGamerGoodies staff member will result in an immediate hold and forfeiture of gifts.

9) Termination

a. FreeGamerGoodies may suspend or terminate your use of the Web Site or FreeGamerGoodies Service if it believes, in its sole and absolute discretion, that you have breached a term of these T&C.

b. Survival. These T&C will survive indefinitely unless and until FreeGamerGoodies chooses to terminate them.

c. Effect of Termination. If you or FreeGamerGoodies terminates your use of the Web Site or the FreeGamerGoodies Service, FreeGamerGoodies may delete any content or other materials relating to your use of the service and FreeGamerGoodies will have no liability to you or any third party for doing so. You are not entitled to a refund of the membership fee if you or FreeGamerGoodies terminates your account.

10) Disclaimers and Exclusions

a. DISCLAIMER OF WARRANTIES. FreeGamerGoodies PROVIDES THE WEB SITE AND FreeGamerGoodies SERVICE ON AN "AS IS" AND "AS AVAILABLE" BASIS. FreeGamerGoodies DOES NOT REPRESENT OR WARRANT THAT THE WEB SITE, FreeGamerGoodies SERVICE OR ITS USE: (i) WILL BE UNINTERRUPTED, (ii) WILL BE FREE OF INACCURACIES OR ERRORS, (iii) WILL MEET YOUR REQUIREMENTS, OR (iv) WILL OPERATE IN THE CONFIGURATION OR WITH THE HARDWARE OR SOFTWARE YOU USE. FreeGamerGoodies MAKES NO WARRANTIES OTHER THAN THOSE MADE EXPRESSLY IN THESE T&C, AND HEREBY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY AND NON-INFRINGEMENT.

b. EXCLUSION OF DAMAGES. FreeGamerGoodies WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE OR SPECIAL DAMAGES (INCLUDING DAMAGES RELATING TO LOST PROFITS, LOST DATA OR LOSS OF GOODWILL) ARISING OUT OF, RELATING TO OR CONNECTED WITH THE USE OF THE FreeGamerGoodies SERVICE, BASED ON ANY CAUSE OF ACTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
